Spade Software LLC ("Company," "we," "us") operates BackOps and the website at backopslive.com (collectively, the "Services"). This Privacy Policy explains what personal information we collect, how we use and share it, and the choices and rights you have. By using the Services you agree to this Policy.

Information We Collect

Information you provide to us:

  • Account and profile data: first and last name, email address, and (if you choose to provide it) phone number.
  • Billing data: company or organization details and payment information. Card payments are processed by Stripe; we do not receive or store full card numbers, only tokenized identifiers and the card brand and last four digits.
  • Content you upload: files, photos, documents, and other materials you add to the Services ("User Content").
  • Communications: messages you send us for support, sales, or general inquiries.

Information collected automatically:

  • Usage and device data: pages viewed, links and buttons clicked, referring page, campaign (UTM) parameters, IP address, and browser or device type.
  • Cookies and similar technologies (see "Cookies and Tracking Technologies" below).

How We Use Information

  • To provide, operate, secure, and improve the Services.
  • To authenticate users and manage accounts.
  • To process payments and manage subscriptions.
  • To send transactional messages (account, security, billing) and, where permitted, marketing communications you can opt out of at any time.
  • To analyze usage and to measure and improve our marketing.
  • To comply with law and enforce our terms.

How We Share Information

We share personal information with:

  • Service providers and sub-processors that operate the Services on our behalf, including Microsoft Azure (hosting, storage, authentication, telemetry), Stripe (payments), Twilio SendGrid (email), and Twilio (SMS messaging). They may use the information only to provide services to us.
  • Advertising and analytics partners. We use Google (Tag Manager and analytics) and Meta (Meta Pixel) on our website. These technologies may share online identifiers and activity with those partners to measure and deliver advertising. Under the California Consumer Privacy Act (CCPA/CPRA) and similar state laws, this activity may be considered "sharing" (and, in some interpretations, a "sale") of personal information for cross-context behavioral advertising. You can opt out, as described below.
  • Legal and safety recipients, when required by law or to protect rights, safety, or property.
  • A successor entity in connection with a merger, acquisition, or sale of assets.

We do not sell your User Content.

Cookies and Tracking Technologies

We and our partners use cookies, pixels, local and session storage, and similar technologies for essential operations, functionality, analytics, and marketing. We group them into the following categories:

  • Essential — required for the Services to function, such as authentication and security.
  • Functional — remember your preferences and attribution context.
  • Analytics — help us understand usage, such as Google Tag Manager and Azure Application Insights.
  • Marketing — measure and deliver advertising across other sites, such as the Meta Pixel.

You can manage non-essential cookies at any time using the cookie banner or the "Your Privacy Choices" link in our footer. In regions that require it, non-essential technologies are not loaded until you consent.

International Data Transfers

We are based in the United States and process data in the United States. If you access the Services from outside the United States, your information will be transferred to and processed in the United States. Where required, we rely on appropriate transfer mechanisms, such as Standard Contractual Clauses and/or the EU-US Data Privacy Framework.

Your Privacy Choices and Rights

  • Opt out of sale, sharing, or targeted advertising. Use the "Your Privacy Choices" link in our website footer. We also honor the Global Privacy Control (GPC) browser signal automatically.
  • Marketing communications. You can unsubscribe using the link in any marketing email. Transactional messages are not promotional and may still be sent.
  • Access, deletion, correction, and portability. Subject to identity verification and legal exceptions, you may request a copy of, deletion of, or correction to your personal information. We respond within the timeframe required by law (generally 45 days, which may be extended where permitted).
  • Non-discrimination. We will not discriminate against you for exercising these rights.

Data Retention

We keep personal information for as long as needed to provide the Services and for legitimate business or legal purposes, after which we delete or de-identify it.

Security

We use administrative, technical, and physical safeguards, including encryption in transit and at rest and access controls. No method of transmission or storage is completely secure.

Children Under Thirteen

The Services are not directed to children under the age of 13, and we do not knowingly collect personal information from them. If you are under 13, you must ask your parent or guardian for permission to use the Services.

Changes to This Policy

We may update this Policy from time to time. When changes are significant, we will provide additional notice, such as by email or a prominent notice in the Services. We will post the new effective date below.
